Your Legal Obligations as a Site Owner

Under the WEEE Regulations 2013 — updated further as part of the UK government's Extended Producer Responsibility programme in 2025/26 — solar panels fall under Category 14 of the WEEE classification. As the site owner or operator, you are responsible for ensuring panels are disposed of through an authorised route, regardless of whether you own the panels or lease the land to a developer.

The legal requirements are clear. You must use a licensed waste carrier registered with the Environment Agency, SEPA, or Natural Resources Wales. You must obtain a Waste Transfer Note at the point of collection and retain it for a minimum of two years. Panels must then be processed at an Approved Authorised Treatment Facility, and you should receive a WEEE Evidence Note confirming compliant treatment. Using a scrap dealer or general waste contractor — however convenient — puts you in direct breach of your Duty of Care.
